ONE of the drunken yobs convicted of kicking Garry Newlove to death in a street attack has lodged an appeal after only 9 weeks behind bars.

Teenager Stephen Sorton was sentenced to life in prison in February and ordered to serve a minimum on 15 years for his part in battering the courageous father to death.

But it was announced today by the Crown Prosecution Service that the 17-year-old has lodged an application for leave to appeal his sentence.

Sorton, who was one of three yobs who kicked the father-of-three's head "like a football", has only completed nine weeks of his sentence.

Courageous Newlove had stood up to the gang for vandalising his wife's car when he was attacked.

The murder sparked outrage and a national debate about Britain’s yob culture.

Judith Edwards, spokeswoman for Cheshire Crown Prosecution Service, said: “We have had notification from the Court of Appeal that Stephen Sorton has made an application for leave to appeal against his sentence.”

Last month, the CPS confirmed Adam Swellings, the ringleader of the gang that attacked Mr Newlove, had also made an application for leave to appeal against his sentence with the Court of Appeal.

Swellings, of Crewe, was jailed for life after he was convicted at Chester Crown Court in January this year and was ordered to serve a minimum of 17 years behind bars.

In February, Swellings’ solicitor Patrick Heald said the minimum 17-year term for the 19-year-old had gone beyond parliament’s recommendation of 15 years for similar crimes. Mr Heald described the minimum tariff as “robust”.


Jordan Cunliffe, 16, formerly of Warrington, was also jailed for life and ordered to serve a minimum of 12 years for Mr Newlove’s murder.

Judith Edwards said the CPS had not heard whether Jordan Cunliffe had made an application for leave to appeal against his sentence.

Today his widow Helen said today: “I’m disgusted. Sorton kicked my husband to death and has never shown a hint of remorse.

“A jury found him guilty and a judge sentenced him on the basis of the evidence.

“It’s a disgrace he can use the legal system to cast doubt over the court decision. We’ve no right to appeal over Garry’s death. Why should they be any different?”

It emerged, after the trio were found guilty on January 16 of Mr Newlove’s murder, that Swellings had been released from custody for an assault just hours before the attack.

He was freed on bail on condition he stayed away from Warrington but he never left the town. Instead he met up with accomplices Sorton and Cunliffe and began a drink and drugs binge.

This appeal is based on the do-gooders constant bickering on human rights...rehabilitation etc.... lets get one thing straight REHABILITATION DOES NOT WORK....as for human rights, what about Mr Newlove's and that of his family?
With DNA evidence available to us, I consider there is only one punishment for these thugs, and let me add we wouldn't have to pay for them to be fed and watered in jail for 12/15 years.............
Oh! and I would be prepared to pull the handle, throw the switch etc.....

My husband WAS a lawyer and I am so pleased he does not practice anymore.

He says that he could never represent such scumbags as those who killed Garry Newlove.

Lawyers are extremely expensive and frequently make mistakes. They cause more problems than they are worth, indulge in cost building exercises and have their own interests rather than their clients at heart.

The government are moaning that they don't have enough prison space, and are continually releasing prisoners early! A cheap and easy remidy- hang all murderers and drug barons and pushers! That should free up plenty of spaces, without building any more prisons! But until that happens, double the scums sentences!
